  • Preparation of forecasting models; and

  • Informal arrangements with creditors

Getting advice early on increases the potential for a successful recovery.

Insolvency

Businesses which are in survival mode are often established companies that have a fundamentally good business however, challenges such as COVID have resulted in a decline in profitability.

These businesses have a future and EMJ can assist in identifying opportunities for restructure and business improvement.

These businesses are usually still solvent and will likely not require a formal insolvent restructure. We will help put the challenges into perspective and guide you through the options available.

Secured Recovery

Often, a creditor will take security over all or some of a company’s assets. When the secured creditor cannot recover the amount owed and the company is in default of the loan agreement, they can appoint a:

  • Receiver and Manager

  • Voluntary administrator (link to existing page on this) or

  • Mortgage in Possession

A secured creditor may seek advice in relation to its rights and obligations and EMJ Consulting can assist with the following:

  • Assistance with registering a secured interest on the Personal Properties Security Register (PPSR)

  • Estimating the security position for the secured creditor

  • Undertaking a review of the company’s financial position and preparing a report on the risks, management’s capability, the estimated outcome of a receivership or other type of appointment.
